The regular meeting of the Town Board of the Town of Ballston was held Thursday evening, January 3, 2008 at the Town Hall on Charlton Road. Members present were Supervisor Patti Southworth, Councilmen James Briaddy, Timothy Szczepaniak, Councilwomen Mary Beth Hynes and Kimberly Ireland. Also present were acting Town Attorney Peter Reilly and Town Clerk Muriel Swatling.

The Pledge of Allegiance was recited and the meeting was called to order by Supervisor Southworth. Supervisor Southworth introduced the Town Board for 2008.

The first order of business was the swearing in of Town Clerk Muriel Swatling and Deputy Supervisor George Seymour by Town Justice Cynthia Amrhein.

A motion was made by James Briaddy and seconded by Mary Beth Hynes that the minutes of the November special meeting, public hearings, septic meeting and December regular meeting be approved. Roll Call: Ayes – all; Noes – none. Carried.

The Town Clerk read the following letters. The first was from Dorothy Hopkinson, Treasurer and Richard Gribben, President of the Hillside Cemetery Association Board of Trustees thanking the Town for their contribution to the Hillside Cemetery Fence Fund. The next was from Ballston Area Community Center thanking the Town for their support of the BACC programs and the BACC playground campaign. The last was a letter from Highway Superintendent Joseph Whalen expressing his concerns and asking for a meeting regarding the curb radii and road width as stated in the TND regulations and the parking on the highways from November through April as relating to the TND regulations.

Highway/Water Superintendent Joseph Whalen, Building Inspector Thomas Johnson, Dog Control Officers John Christopher and Thomas Shambo, and Town Clerk Muriel Swatling have submitted monthly and year end reports, and they are on file in the Town Clerk’s office.

Town Historian Richard Reynolds presented a year end report and Deputy Town Clerk Carol Shemo submitted a year end report for use of the William Sewell Community Room, both of which are on file in the Town Clerk’s office.

Councilwoman Hynes reported that an application prepared by C. T. Male has been sent to National Grid requesting permission to extend the bike path from Outlet Road to Brookline Road.

Supervisor Southworth thanked the outgoing Board members and Attorney Pott for their years of service to the Town of Ballston. Mrs. Southworth announced her County committee assignments as follow: Buildings/Grounds; Equalization/Assessment; Public Works and Public Health. The Town is also looking for a new Town Attorney, and Town Historian Rick Reynolds is looking for volunteers to help catalog newspaper articles.

Rick Reynolds will give a presentation on 20th Century Town of Ballston at the Town Hall at 7:00 p.m. on January 16th. Douglas Farrar is the Town’s representative to the County Fire Advisory Board. The Citizen Transportation of Saratoga County Committee is looking for representatives from the Town of Ballston. The Committee is working to improve bus, rail, taxi and pedestrian transportation.

The Supervisor’s financial report for the month of December was presented.

Arnold Palmer congratulated the Board for 2008. They were put there by the people; not by any particular party. You have the map for the Ballston Lake Overlay District and MS-4. Why was my property put in to save Ballston Lake. Why are you voting on this tonight? You are taking someone’s rights away. Let other people go play in the lake.

Supervisor Southworth explained that the Town is trying to protect the lake.

Edward Guider of Ballston Lake spoke to the Town Board regarding domestic violence. He feels there should be a standing committee to monitor the situations in the Towns in Saratoga County. The Town of Ballston could help with this project. Mr. Guider also feels the Town should adopt a policy for employees with training and talking; not just a paper policy.

Carl Thurnau retired as the Town representative from the County Fire Advisory Board. Mr. Thurnau thanked the Town for the privilege of serving in that capacity.

Donald Rhodes feels that the Town should talk to the people in the Ballston Lake Overlay District. He feels the district should be left alone as is.

The organizational resolutions and appointments were presented.

Councilwoman Ireland asked why the Supervisor was on seven committees and the Councilpeople were on only three or four. Supervisor Southworth replied that since she and Councilman Briaddy are not working, they took more. Councilwoman Hynes stated that she would like to be on the Open Space Committee; why was it changed? Councilman Szczepaniak said he has 30+ years experience in buildings and highway; why wasn’t he put on those committees. Supervisor Southworth stated that everyone is welcome to come to all the meetings and speak.

Organizational Resolutions:

RESOLUTION #1 – BE IT RESOLVED BY THE Town Board of the Town of Ballston that all meetings of the Town Board shall be held in accordance with the latest edition of Robert’s Rules of Order.

RESOLUTION #2 – BE IT RESOLVED by the Town Board of the Town of Ballston that all regular meetings of the Town Board of the Town of Ballston shall be held in the Town Offices located on Charlton Road, Town of Ballston and County of Saratoga at 7:30 p.m. on the first Tuesday of each month, except in November when it shall be the first Thursday at 7:30 p.m. A special meeting will be held on the last Tuesday of each month (Agenda Meeting) for the purpose of paying monthly bills and any other business requiring immediate attention.

RESOLUTION #3 – BE IT RESOLVED by the Town Board of the Town of Ballston that the Agenda Meetings of the Town Board shall be held at the Town Offices located on Charlton Road, Town of Ballston and County of Saratoga at 7:30 p.m. on the last Tuesday of each month.

A motion was made by Timothy Szczepaniak and seconded by Mary Beth Hynes that Resolution #3 be approved. Roll Call: Ayes – all; Noes – none. Carried.

RESOLUTION #4 – BE IT RESOLVED by the Town Board of the Town of Ballston that the Ballston Spa National Bank shall be the official depository for town funds. Be it further resolved that funds may be withdrawn and checks may be signed by the Supervisor, Patti Southworth, or in her absence by Deputy Supervisor, George Seymour, in accordance with the provisions of the Town Law and the procedures established by the Town Board. Be it further resolved that checks drawn on the Town Clerk’s account may be signed by the Town Clerk or the Deputy Town Clerk in accordance with the provisions of the Town Law and the procedures established by the Town Board. The Ballston Spa National Bank will deposit with a third party collateral sufficient to cover all balances.

RESOLUTION #5 – BE IT RESOLVED by the Town Board of the Town of Ballston that salaries for Town Officials in 2008 and rates for hourly employees in 2008 be approved as listed and established in the 2008 Budget, and that the payroll schedule be: Biweekly – all hourly employees; all elected officials and salaried employees.

RESOLUTION #6 – BE IT RESOLVED by the Town Board of the Town of Ballston that the Water Superintendent be authorized to make purchases on his own authorization up to a limit of $3,000.00.

RESOLUTION #7 – BE IT RESOLVED by the Town Board of the Town of Ballston that a petty cash account of $300.00 be authorized for use by the Town Clerk and a petty cash account of $300.00 be authorized for use by the Town of Ballston Community Library.

RESOLUTION #8 – BE IT RESOLVED by the Town Board of the Town of Ballston that the official newspaper as required by Town Law shall be the Daily Gazette.

RESOLUTION #9 – BE IT RESOLVED by the Town Board of the Town of Ballston that Town Officers shall be compensated at the rate of .505 cents per mile for the use of their personal automobiles in the performance of their official duties.

RESOLUTION #10 – BE IT RESOLVED by the Town Board of the Town of Ballston that all elected and appointed officers of the town shall be authorized to attend meetings and conferences connected with their office and shall be reimbursed for necessary expenses and mileage at the approved rate upon the submission of the proper voucher within the limits of the budget. Overnight trips shall require prior approval by the Town Board.

RESOLUTION #14 – BE IT RESOLVED by the Town Board of the Town of

Ballston that all official meeting minutes must be written and mailed or otherwise distributed to appropriate parties within seven days of the applicable meeting. Town Board meeting minutes must, at a minimum be sent to: all Town Board members, Town Attorney and Deputy Town Attorney, Highway Superintendent, Building Inspector, Water Superintendent, Zoning Enforcement Officer, Assessor, Tax Collector, Town Justices, Town Librarian, Dog Control Officer, Town Historian, Chairperson of Zoning Board and Planning Board, Town Engineer, and others as required by the Town Board in special circumstances. The Zoning Board of Appeals (ZBA) meeting minutes must be sent to all ZBA members, all Town Board members, the Town Attorney and the Deputy Town Attorney, the Chairperson and Secretary of the Planning Board, the Highway Superintendent, Building Inspector, Zoning Enforcement Officer, Assessor, Town Engineer, applicants before the ZBA, and other persons as needed. RESOLUTION #15 – BE IT RESOLVED by the Town Board of the Town of Ballston that the Town Attorney (representing the Town Board) and the Contracted on Contract Attorney (representing the Planning and Zoning Boards) appointed by the Town Board, will not represent clients before any of the standing boards of the Town or undertake criminal defense work before the Courts of the Town of Ballston.

RESOLUTION #17 – BE IT RESOLVED by the Town Board of the Town of Ballston that the firm of C. T. Male is hereby appointed Town Engineer. The Town Engineers agree not to represent any clients within the Town of Ballston before any duly established town board (i.e. Town Board, Planning Board, Zoning Board of Appeals).

RESOLUTION #18 – BE IT RESOLVED that the Town Board of the Town of Ballston authorized the Budget Officer to make transfers between accounts in the current budget in order to keep accounts properly funded. The Supervisor will report transfers monthly to the Town Board.

RESOLUTION #19 – BE IT RESOLVED the Town Council of the Town of Ballston is hereby authorized and directed to prepare and distribute up to four newsletters to the residents of the Town of Ballston relative to the activities of the Town Board during the year 2008.

RESOLUTION #20 – BE IT RESOLVED that Deputy George Seymour be authorized to sign checks on Town Justice Cynthia Amrhein and Town Justice Brandi Burns checking accounts.

Kathryn Serra of C. T. Male Associates was present to give an overview of the Ballston Lake Overlay District and MS-4 Map and Illicit Discharge (Chapter 92). Mrs. Serra stated that the MS-4 region is determined by the EPA. The amount of land that can be disturbed in the MS-4 area is equal to that determined by New York State. That amount reads that rules are more restrictive if a construction project is disturbing more than one acre of soil.

The regulations for the Ballston Lake Overlay District are above and beyond those of the MS-4.

The illicit discharge means that residents cannot dump contaminants. It is not more restrictive than the State regulations.

Councilwoman Hynes stated that a public hearing has been held on the present map. There is a January 8th deadline for having this information in place. The Town will have to pass this map and then go back and look at the map again.

Councilman Briaddy said the map will change in the first half of the year 2008.

Councilwoman Hynes also stated that the wording for the Ballston Lake Overlay District has to be defined.

Councilman Szczepaniak said that he has a clear understanding that we need to have another look at the boundaries of the map.

08-02: A motion was made by James Briaddy and seconded by Timothy Szczepaniak to approve the Ballston Lake Overlay District and MS-4 Map. Roll Call: Ayes – all; Noes – none. Carried.

08-03: A motion was made by James Briaddy and seconded by Timothy Szczepaniak to adopt Local Law No. 1 of the year 2008 amending Chapter 91, Stormwater Management, of the Code of the Town of Ballston. Roll Call: Ayes – all; Noes – none. Carried.

08-04: A motion was made by James Briaddy and seconded by Mary Beth Hynes to adopt Local Law No. 2 of the year 2008 to amend the Code of the Town of Ballston by adding Section 92, Prohibits Illicit Discharges, Activities and Connections to Separate Storm Sewer System. Roll Call: Ayes – all; Noes – none. Carried.

08-05: A motion was made by James Briaddy and seconded by Mary Beth Hynes to authorize the payment of $50.00 toward the prescription drug deductible, per person covered annually, and $500.00 deductible for hospital stay per person, covered annually. Roll Call: Ayes – all; Noes – none. Carried.

08-06: A motion was made by Mary Beth Hynes and seconded by Kimberly Ireland to set a public hearing for Burnt Hills-Ballston Lake Water District No. 2, Ext. #21, corner of Eastline Road and Round Lake Road, for January 29, 2008 at 7:00 p.m. Roll Call: Ayes – all; Noes – none. Carried.

The Association of Towns is holding its Training School and Annual Meeting in New York City from February 17 – 20, 2008. Overnight trips require approval by the Town Board.

08-07: A motion was made by Mary Beth Hynes and seconded by Kimberly Ireland to authorize a maximum of ten attendees at the Association of Towns Meeting in New York City from February 17 – 20, 2008. Roll Call: Ayes – all; Noes – none. Carried.

08-08: A motion was made by James Briaddy and seconded by Mary Beth Hynes to approve the annual contracts with Saratoga County Office of the Aging for 2008 as follow:

Zoning Board Chairman, Michael Lesniak, thanked Councilwoman Hynes for drafting the following resolution honoring Edward Hickey. The Zoning Board lost two dedicated members during 2007, Donald Brown and Edward Hickey.

08-09: A motion was made by James Briaddy and seconded by Mary Beth Hynes to approve the following resolution honoring Edward Hickey. Roll Call: Ayes – all; Noes – none. Carried.

WHEREAS, Edward A. Hickey died on December 15, 2007; and

WHEREAS, Edward A. Hickey was a resident of the Town of Ballston; and

WHEREAS, Edward A. Hickey was a member of our Town of Ballston Jenkins Park Advisory Board from 1988 – 1994 and served on the Town of Ballston Zoning Board of Appeals from 2003 - 2007, and in these capacities served this Town and our community; and

WHEREAS, Edward A. Hickey also lent his skills, experience, time and talent to a variety of organizations in the Town of Ballston, including Our Lady of Grace Church, the Burnt Hills/Ballston Lake School District, the Burnt Hills-Ballston Lake Junior Baseball League and several youth and high school sport programs; and

WHEREAS, the Town of Ballston wishes to express its deep sympathy to Mr. Hickey’s wife of 39 years, Mary Ellen Hickey; to his five children and their spouses; and to the rest of his extended family; now, therefore, be it

RESOLVED, that the Town Board of the Town of Ballston expresses its sympathy to the Hickey family upon the loss of Edward Hickey, and further expresses its gratitude to Edward Hickey for his years of service to the Ballston community, most recently as a member of the Town of Ballston Zoning Board of Appeals. Volunteers like Mr. Hickey are the backbone of a community such as ours, and we are all poorer for no longer having him with us.

08-10: A motion was made by Mary Beth Hynes and seconded by James Briaddy to approve a resolution commending the Ellms Christmas Tree Farm and the Ellms Family for their participation in the National Christmas Tree Grower’s Association Program to Bring Christmas Trees to our service men and women and their families during the Holiday Season. Roll Call: Ayes – all; Noes – none. Carried.

WHEREAS, the Ellms Christmas Tree Farm is a family-run agricultural business located on Charlton Road in the Town of Ballston; and

WHEREAS, the Ellms Christmas Tree Farm and the Ellms family are members of the National Christmas Tree Growers Association; and

WHEREAS, for three years the Ellms Christmas Tree Farm has participated in a program to collect and distribute Christmas trees to soldiers and to the families of soldiers overseas; and

WHEREAS, this year at a national level approximately 16,500 trees were collected and distributed to 35 U.S. bases and to at least seventeen different countries, including Iraq and Afghanistan; and

WHEREAS, the Ellms Christmas Tree Farm acted as the pick-up point for Eastern New York State, and collected 125 trees --- some of which were donated by other local farms such as Goode Farm on Goode Street and Holland Farm on Middleline Road; and

WHEREAS, these trees were brought to Fort Drum in Watertown, New York and Fort Leonard Wood in Missouri and were distributed to soldiers or to families of enlisted military people; and

WHEREAS, the Town of Ballston Town Council wishes to commend Ellms Christmas Tree Farm and the Ellms family for their effort to bring a small reminder of home to our brave service men and women during the holiday season; now, therefore, be it

RESOLVED, that the Town Board of the Town of Ballston recognizes and commends the Ellms Christmas Tree Farm and the Ellms family for their participation in the National Christmas Tree Growers Association Program to bring Christmas trees to our service men and women and their families during the holiday season. Their commitment to our men and women in uniform is a credit to them and is a point of pride for the Town of Ballston. We are proud to have the Ellms family and their business in our Town.

The date of the February Town Board meeting needs to be changed due to the fact that Primary Election Day is February 5, the same day as the Town Board scheduled meeting.

08-11: A motion was made by James Briaddy and seconded by Mary Beth Hynes to approve the change of the February Town Board meeting from Tuesday, February 5, 2008 to Thursday, February 7, 2008 due to the scheduled Primary Election. Roll Call: Ayes – all; Noes – none. Carried.

3 Daughters Realty has received permission from the Clifton Park Water Authority to access water from Clifton Park to service their property located at 115/117 Eastline Road. They now need the approval of the Town of Ballston.

08-12: A motion was made by James Briaddy and seconded by Timothy Szczepaniak to approve the request of 3 Daughters Realty to access the Clifton Park Water Authority System to service 115/117 Eastline Road, at no cost to the Town of Ballston. Roll Call: Ayes – all; Noes – none. Carried.

Arnold Palmer asked what the Town of Clifton Park is doing regarding the MS-4.

Frank Shipp asked that the Town update their website.

David Stern said he would be glad to help with the website.
