The regular meeting of the Town Board of the Town of Ballston was held Tuesday evening, March 4, 2008 at the Town Hall on Charlton Road. Members present were Supervisor Patricia Southworth, Councilmen James Briaddy, Timothy Szczepaniak, Councilwomen Mary Beth Hynes and Kimberly Ireland. Also present were Town Attorney Murry Brower and Town Clerk Muriel Swatling.
Supervisor Southworth called the meeting to order at 7:30 p.m. and the Pledge of Allegiance was recited.
Supervisor Southworth asked to observe a Moment of Silence for Highway employee, Daniel Merchant, who passed away suddenly on February 22nd.
Councilwoman Kimberly Ireland stated she has a correction to the February 7th minutes. On page 197, paragraph 5 should be changed to read as follows: Councilwoman Ireland asked Deputy Supervisor Seymour if he had any information regarding the Senator Farley member item grant. There may be a possibility of grant money to use for a light by the Burnt Hills High School.
A motion was made by James Briaddy and seconded by Mary Beth Hynes that the minutes of the public hearings, special meetings and February regular meeting be approved as corrected. Roll Call: Ayes – all; Noes – none. Carried.
Sharon Rouis from the Library Board of Trustees presented the Library report for the month of February, a copy of which is on file in the Town Clerk’s office.
Building Inspector Thomas Johnson, Highway/Water Superintendent Joseph Whalen, Dog Control Officer John Christopher, Deputy Dog Control Officer Thomas Shambo, Supervisor Patti Southworth and Town Clerk Muriel Swatling submitted reports for the month of February, and they are on file in the Town Clerk’s office.
Sue Macejka, Chairwoman of the Jenkins Park Advisory Board, reported that she has been referring to the By-Laws for Jenkins Park when conducting Park business and communicating with the Supervisor. Mrs. Macejka thanked everyone for their support, and she thanked Mr. Palmer for his donation. Mrs. Macejka also stated there will be a meeting of the Jenkins Park Advisory Board and the Town Board on March 27, 2008 at 7:00 p.m. in the Sewell Community Room. There has been a breakdown of communications, and they want to mend that break. This is a meeting for "everybodys" park. The list of proposed projects for 2008 will be the starting point. Additional items including discussion of a dog park and multi-use fields will also be included.
Supervisor Southworth said she had attended a meeting with the Town of Malta regarding recreation and could give some of the information obtained from that meeting.
Supervisor Southworth reported that the Sales Tax for 2007 was off by 2%. The County will keep watch for 2008. A program on local history will be presented by Town Historian Richard Reynolds for children in grades 4 through 12 at the Town Hall on Saturday, March 8 at 11:00 a.m. The classes at the Association of Towns Annual School were very educational. One of the main topics at the Business Session of the Annual Meeting was relief from unfunded Federal and State mandates. At the County level, the Animal Shelter has started a Senior to Senior program. An owner over the age of 60 years is matched with a pet over the age of 5 years at no cost. The Town is going to start recycling office paper. It keeps the paper out of landfills and brings in money to the County. The County made $847,300 from recycling in 2007. There will be a series of rabies clinics held throughout the year at the 4-H Training Center provided by Saratoga County. Supervisor Southworth also reported that she rode in one of the highway plow trucks during a recent snowstorm and thanked the Highway Department for that opportunity. Mrs. Southworth also stated that Donald Grupe had talked to her regarding a parcel of land he has for sale on the corner of Finley Road and
Route 67. He asked if the Town would be interested in purchasing this parcel for open space. It is a 22 acre parcel and the asking price is $299,000.
At the special Town Board meeting held on February 26th, a motion was made to appoint a Town Attorney with the stipulation that there be a contract. There does not need to be a contract so the motion needs to be amended.
08-30: A motion was made by Mary Beth Hynes and seconded by James Briaddy to amend Resolution 08-29 to read as follows: A motion was made by Kimberly Ireland and seconded by James Briaddy to appoint Murry Brower as Town Attorney for a term commencing February 26, 2008 and ending December 31, 2009. Roll Call: Ayes – all; Noes – none. Carried.

Merrill McColl asked about the formation of Jenkins Park. It was replied that the New York State Legislature has to set up the special district. The Advisory Board sets the budget and projected amount of money to be collected.
Arnold Palmer asked where the Town Board is on the Ballston Lake Overlay District.
Councilwoman Hynes replied that they are looking at the map (they had three options), and are working on the revision of the wording.
Mr. Palmer stated that the Board needs to communicate with the residents and let people in the proposed Overlay District know what is going on.
Councilwoman Hynes responded that the Town will put this information in the newsletter to inform the residents of the Town, and it will also be put on the website.
Polly Windels stated that at the last meeting when asked why a specific matter was on the agenda was told that the agenda was the Supervisor’s agenda. Ms. Windels said it is everybodys’agenda. The Town Board has to work for their agenda. I encourage the Town Board to consider the agenda as a Town agenda and not individual agendas.
George Seymour asked about the water system contracts. Two of the largest water users, the City of Saratoga Springs and the Town of Clifton Park, are not part of the County system. When the decision is made regarding which system to go with, will there be public input on what way to go.
It was replied that the decision had already been made at the March 6, 2007 Town Board meeting.
Supervisor Southworth said we have to give Attorney Brower time to review the water contracts.
Councilwoman Hynes told Mr. Seymour that if he has any questions, to give her a list and she would provide answers for him.
The following items were presented for discussion and action.
The Town’s contract with Command Security Corporation for court security is due for renewal. Attorney Brower has some questions regarding this contract, so it was decided to table this action.
08-31: A motion was made by Mary Beth Hynes and seconded by Timothy Szczepanial to table the motion to approve renewal of the contract with Command Security Corporation for court security. Roll Call: Ayes – all; Noes – none. Carried.
The Town is going to enter into an agreement with Ballston Spa National Bank for electronic banking. Attorney Brower would like some time to talk to the Bank regarding this agreement so it was decided to table this action at this time.
08-32: A motion was made by Timothy Szczepaniak and seconded by James Briaddy to table the motion to approve the agreement with the Ballston Spa National Bank for electronic banking. Roll Call: Ayes – all; Noes – none. Carried.
08-33: A motion was made by James Briaddy and seconded by Mary Beth Hynes to approve a reimbursement of $100.00 application fee for the Zoning Board for a withdrawn zoning permit. Roll Call: Ayes – all; Noes – none. Carried.
08-34: A motion was made by James Briaddy and seconded by Mary Beth Hynes to approve the following resolution honoring former Councilman Robert Boice. Roll Call: Ayes – all; Noes – none. Carried.
WHEREAS, Robert C. Boice was born and raised in the Town of Ballston, the second of four children, and
WHEREAS, from the age of 12, Mr. Boice was a dairy farmer, working on his family’s dairy farm on Goode Street, where they had about 85-90 head of cattle, and milked over 50 cows each day, and
WHEREAS, Robert C. Boice attended high school in Burnt Hills in the building now known as Stevens Elementary School, which was at that time the only school in the district, and while there excelled in athletics, particularly basketball, soccer, and baseball, which were the only three sports offered at the school, and
WHEREAS, when he walked home from high school in the early 1950’s there were only three houses between Lakehill Road and his home on Goode Street, and
WHEREAS, following his graduation from high school in 1952 Mr. Boice attended Cornell University for one year, studying agriculture, returning home in 1953 to work with his father on the family’s dairy farm on Goode Street in Burnt Hills, and
WHEREAS, Robert C. Boice had the great good fortune to marry Joyce Boyce in 1953, and they will celebrate 55 years of marriage in October of this year, and
WHEREAS, from the age of 21 to today, Robert C. Boice has lent his time, energy and talent in service to his community as a volunteer firefighter in the Town of Ballston, serving as Assistant Chief for 15 years, as Chief for 3 years, and having held an office with the fire department for approximately 50 years, and
WHEREAS, at the urging of Clifford Thompson, former head of the Town of Ballston Highway Department, Robert C. Boice ran for office as Town Councilman and was elected in 1992, and
WHEREAS, Robert C. Boice was a Town Councilman for the Town of Ballston for 16 years, and in that capacity served this Town and our community, and
WHEREAS, as a Town Councilman, Mr. Boice played a vital role in the formation and construction of the Town of Ballston Highway garage, the Town of Ballston Community Library, and the new addition to the Town of Ballston Town Hall, and
WHEREAS, Robert C. Boice and his wife Joyce are the loving parents of five children: Shirley, Deborah, Bonny, Kathleen Joy, and Robert Jr., loving grandparents of seven wonderful grandchildren, and are expecting their first great-grandchild this summer,
WHEREAS, the Town of Ballston wishes to express its deep gratitude to Robert C. Boice for his years of community service through his involvement with both the Town Council and the Burnt Hills Fire Department. Mr. Boice has lived his entire life in our Town, has seen many changes in our community, and has helped this Town prosper and succeed; now, therefore, be it
RESOLVED, that the Town Board of the Town of Ballston recognizes and honors Robert C. Boice for his outstanding service to the Town of Ballston and its residents.
Councilwoman Ireland presented a memo to the Town Board outlining some ideas for Town Website Updates.
Councilman Szczepaniak asked the status of the property at 23 Nolan Road and Cole’s Junk Yard.
Attorney Brower will review the file on the property at 23 Nolan Road and make a recommendation and the Cole’s Junk Yard issue is in the Court so the Town can do nothing at this time.
Councilwoman Ireland stated that she has spoken to Attorney Peter Reilly about his inquiry regarding using parks and recreation funds for Jenkins Park. She said that Attorney Reilly has been playing telephone tag with the Comptroller’s office and will let us know when he receives an answer.
